(Phone rings)

Adama: Yes.

Roslin: Yell at me, I don't wanna get out of bed.
Adama(Phone): Well you called the wrong number, I was just thinking about going back to bed.
Roslin: You feeling okay?
Adama(Phone): Says the cancer patient. Yeah, I'm fine, I just cut myself. How are you doing?
Roslin: I don't want to face them. I don't want to face any of them. I just wanna stay in bed all day and sleep.
Adama(Phone): I think I stopped the bleeding. If you still need to be yelled at, I think I can give you some volume.
Roslin: Okay, alright, give it your best shot.
Adama(Phone): Get outta that bed.
Roslin: That's not your best shot.
Adama(Phone): Get your fat lazy ass outta that rack, Roslin!
Roslin: Yes sir okay sir anything you say sir! Thank you.
Adama(Phone): Don't let them see you sweat, Laura.

(Galactica - Tyrol's Quarters)

(Galen hums a song in his sleep. He then hears the song and gets out of bed, searching for it.)

Galen: Frak.

(Galactica - officer's rack)

Anders: Come here.
Tory: I can't.
Anders: Come here.
Tory: I gotta go back to the Colonial One.
Anders: No, you don't gotta go anywhere.

(They make out, and both hear the strange music)

Tory: What is that music? Gods.
Anders: What did you just say? (Knock on the door) Frak. Yeah, coming.
Seelix: Hey, why is the door locked?
Anders: Sorry.

(Galactica - Lee's Quarters)

Lee: We should go for a mistrial.
Baltar: What? What's he talking about? What are you talking about? Mistrial? Whatever for?
Lee: Because we're losing.
Baltar: Not from where I'm standing. We're actually doing quite well, we - we're just about to break the prosecution, we've blown two of their key witnesses out of the water what more do we need to do for God's sake?
Lee: Everyone in that courtroom hates you, everyone, including the judges. You didn't hear what my father just called you, he called you a "traitorous piece of garbage" a man who doesn't even deserve a trial.
Romo: He said that, he actually said that.
Lee: Yes he did. And I don't think he's the only one up there.
Romo: I agree, our tactical victories are pissin 'em off.
Baltar: Right, so now because we're winning we're losing, actually?
Romo: Perverse isn't it? One of the reasons why I love what I do.
Lee: "Forcing a mistrial may seem of little benefit to either side, but in fact it can be a boon to the defense. The prosecution's shown their hand, at retrial, the defense has all the tactical advantages and the statistical chances of an acquittal rise, by twenty five percent."

Romo: Smart man, your Grandfather.
Baltar: Yeah well I can see why you'd want a mistrial.
Lee: I'm sorry, what's that supposed to mean?
Baltar: Well that'd be the quickest way, wouldn't it? For you to absolve all your responsibility, wash your hands of the whole affair. You get back to your life, you get back to wherever you get back too and I get back to a cell and I have to go through this all over again. I can't physically take that. No more games, no mistrials. There will be a verdict.

(Galactica - Hanger Deck)

(Two deckhands are watching a re-cap of the trial)

Re-Cap: Yesterday marked a surprising turn of events in the trial of Dr. Gaius Baltar when Colonel Tigh admitted to killing his wife…

Racetrack: Before any of you nuggets can think about flying one of my Raptors, you have to know systems. Electronics, avionics, navigation, engine control, DRADIS configuration, auto-pilot gear, and propulsion systems. The best way to learn that is on a Raptor. That means getting your hands dirty. (Anders continues to hear the song - he notices that Galen is humming it too)

Anders: Chief.
Galen: Hey Sam.
Anders: That song you're hummin. What is that?
Galen: Oh, uh. Ah you know I don't even know, it's just something I can't get outta my head. Some way outta here.
Anders: I've been hearing that, everywhere. The boom box you know, in the bar.
Galen: You hear, that song?
Anders: Yeah, it's freaking me out. I hear it everywhere but I can't really hear it, you know what I mean.
Galen: Yeah, it's like you can grab just part of the melody and then it goes away, like it's something from.
Anders: Childhood. Exactly.
Racetrack: Yo Anders! Do you need a fraking invitation? Move it!
Anders: Alright. No reason to get excited.

(Galactica - Sick Bay)

Cottle: Well congratulations, you've survived your first dioxin treatment.
Roslin: Talk about the cure being worse than the disease.
Cottle: Well next time bring a book or some paperwork to help keep your mind off it, it'll also keep your blood pressure down.
Roslin: Yeah right.
Cottle: Now if you'll excuse me I do have some other patients.
Roslin: Alright, go.

(Roslin's dream - Kobol Opera House)

(Roslin, Six, and Sharon are chasing Hera)

Roslin: Hera!

(Six picks up Hera and takes her into the main hall, where Baltar is waiting)

Roslin: AHHH!
Sharon: AHHH!
Cottle: What's going on? You're both freaking out at the same time?
Roslin: We need a moment. Take this off, get this off me, please.
Cottle: Will someone please tell me what the hell is going on?

(Galactica - Cell)

Roslin: Go outside, thank you we'll be fine, shut the door.
Marines: Yes, ma'am.
Roslin: I'm sorry about the shackles. Were you with us, a moment ago, in the lobby of the opera house? I'll take that as a yes by the look on your face.
Sharon: I was there too, and so was Hera.
CapSix: That shouldn't be possible.
Sharon: Yeah. Add it to the list.
Roslin: Were you trying to reach Hera?
CapSix: I don't know, I just knew that I had to protect her with my life.

(Galactica - Adama's Quarters)

Tigh: I'm telling you Bill, they put the music in the ship, I can hear it!
Adama: I believe you, I'll look into it.
Tigh: You'll look into it? You'll look into it? I am here telling you there is Cylon sabotage aboard our ship!
Adama: Sabotage? With music?
Tigh: I know I know, I can't quite understand it myself. There's too much confusion.
Adama: I promise I'll look into it. Now I have to get to court.
Tigh: Okay. Okay. Go to court. There must be some kinda way outta here.

(Galactica - Courtroom)

Cassidy: Do you recognize this document, Lieutenant?
Gaeta: Yes I do, it's a death list, issued on New Caprica by the office of the President.
Cassidy: Who signed this document?
Gaeta: President Gaius Baltar.
Cassidy: Hrm. Could it be a forgery?
Gaeta: No.
Cassidy: And how do you know that it cannot be a forgery?
Gaeta: Because I was there, I saw him sign it.
Baltar: What?! What are you talking about, you weren't there? That's a lie, that's a total fabrication!
Main Judge: Order!
Gaeta: I saw him sign it.
Cassidy: Describe the scene, would you?
Gaeta: The Cylons brought the document into the President office. They'd already selected the names. One of them, I believe it was a three, gave the list to the President and said, "here are the people that are going to be executed, please sign this." He looked at the list, he saw all the names, then he signed it.
Cassidy: Did he protest? I mean did he argue? Did he offer any resistance whatsoever?

(Baltar remembers signing the paper)

Doral: Sign it!
Baltar: I won't do it, you're going to have to solve your consciousness some other way.
Doral: Sign it! Sign your name! Sign it!

(Back to the courtroom)

Gaeta: No, he never did.
Baltar: Oh Felix, oh Felix what are you doing? Get that outta my face.
Lee: Gaius, Gaius.
Main Judge: Counsel will you control your client.
Baltar: Look it's no secret.
Romo: Quiet.
Baltar: The whole fleet knows this man tried to stab me through the next and you missed! Butterfingers!
Romo: Sorry your honors.
Lee: Shut up.
Cassidy: No further questions.
Main Judge: Your witness, councilor.
Romo: No questions.
Baltar: What!
Adama: Witness is dismissed.
Baltar: Oh, oh great. What the hell are you doing!
Romo: It's your word against his. If he's decided to perjure himself there's nothing we can do to change that now. We'll have to adjust our strategy.

(Galactica - Courtroom)

Main Judge: Is the defense prepared to present their case?
Romo: Your honors, at this time, if it would please the court, uh. I would like to offer a motion. The defense would like to move for a mistrial.
Baltar: No, we do not want a mistrial! I do not want a mistrial!
Main Judge: Gaius Baltar!
Judge: Behave, Dr. Baltar. Oh what grounds, counselor?
Romo: On the grounds that one of the panel has already pre-judged the outcome of this trial and determined the guilt of the defendant.
Adama: That's a very serious charge, Mr. Lampkin. Which judge?
Romo: That would be you, Admiral. And to prove it, I need to take the unusual step of calling Mr. Lee Adama to the stand.
Lee: You gotta be fraking kidding me!
Romo: Gaeta sunk us. This is the only way we're going to win.
Lee: I will not testify against my father.
Romo: That is your choice, either way, I'm putting you on the stand.
Cassidy: Your honors, this is completely improper, counsel cannot testify a trial under any circumstance.
Romo: I can cite at least seven precedents off the top of my head.
Main Judge: Call your witness, counselor.
Romo: Thank you. Mr. Adama? Mr. Adama, did you meet with your father, Admiral Adama, four days ago?
Lee: Yes.
Romo: At that meeting, did Admiral Adama express an opinion as to wither the defendant deserved a trial? All I'm lookin for is the truth here, Mr. Adama. Let's have it. I'm waiting. Answer the question. You swore an oath as an officer of the court if you don't answer the question you hold the entire system of justice…
Lee: What fraking system!?
Main Judge: Mr. Adama!
Romo: I'm sorry your honors, please excuse my associate. Alright, alright, I'll try something else. Do you believe that the defendant deserves a free trial?
Lee: As a matter of fact, I do.
Romo: Why?
Lee: Well, aside from the fact that everyone deserves a fair trial, I also happen to believe that he is not guilty of the charges and should be acquitted.
Cassidy: Your honors, I must exist on an exception here. He cannot testify in this manner, it's completely improper.
Lee: I agree!
Cassidy: He can make his arguments in closing statements, not on the stand.
Main Judge: I'm inclined to agree with the prosecution.
Cassidy: Thank you.
Adama: You can appeal to the President if you feel that this influences the verdict. But I for one would like to hear this witness testify.
Judge: I would second that.
Main Judge: Continue.
Romo: Thank you, your honors. Mr. Adama. Mr. Adama?
Lee: Yes.
Romo: Why do you believe that the defendant, Gaius Baltar, deserves to be acquitted?
Lee: Well because the evidence does not support the charges.
Romo: Come on.
Lee: Did the defendant make mistakes? Sure, he did. Serious mistakes. But did he actually commit any crimes? Did he commit treason? No. I mean it was an impossible situation, when the Cylons arrived, what could he possibly do, what could anyone have done? I mean ask yourself, what would you have done? What would you have done? If he had refused to surrender, the Cylons would have probably nuked the planet right then and there. So did he appear to cooperate with the Cylons? Sure. So did hundreds of others. What's the difference between him and them? The President issued a blanket pardon, they were all forgiven, no questions asked. Colonel Tigh, Colonel Tigh used suicide bombers, killed dozens of people, forgiven. Lieuteninet Agathon and Chief Tyrol, they murdered an officer on the Pegasus. Forgiven. The Admiral, the Admiral instituted a military coup d'tat against the President, forgiven. And me? Well, where do I begin? I shot down a civilian passenger ship. The Olympic Carrier, over a thousand people on board, forgiven. I raised my weapon to a superior officer, committed an act of mutiny, forgiven. And then, on the very day when Baltar surrendered to those Cylons, I, as Commander of Pegasus, jumped away. I left everybody on that planet alone, undefended, for months! I even tried to persuade the Admiral never to return. To abandon you all there for good. If I had my way nobody would have made it off that planet. I'm the coward, I'm the traitor. I'm forgiven. I'd say we're very forgiving of mistakes. We make our own laws now, our own justice. And we've been pretty creative of finding ways to let people off the hook for everything from theft to murder. And we've had to be, because we're not a civilization anymore. We are a gang, and we're on the run, and we have to fight to survive. We have to break rules, we have to bend laws, we have to improvise. But not this time, no, not this time. Not for Gaius Baltar. You, you have to die. You have to die because well, we don't like you very much. Because you're arrogant, because you're weak, because you're a coward. And we the mob, we want to throw you out the airlock because you didn't stand up to the Cylons and get yourself killed in the process. That's justice now. You should have been killed back on New Caprica, but since you had the temerity to live we're going to execute you now. That's justice.

(crowd reacts to Lee's speech)

Main Judge: Order, order.
Lee: This case, this case is built on emotions, on anger, bitterness, vengeance, but most of all, it is built on shame. It's about the shame of what we did to ourselves back on the planet, and it's about the guilt of those of us who ran away. Who ran away. And we are trying to dump all that guilt and all that shame onto one man, and then flush him out the airlock and hope that that just gets rid of it all. So that we can live with ourselves. That won't work. That won't work. That's not justice, not to me. Not to me.
Romo: No further questions.
Cassidy: Your honors, I wish to reiterate my strong exception to defense counsels testimony.
Main Judge: Exemption noted.
Cassidy: Thank you.
Main Judge: Did you want to cross examine the witness?
Cassidy: I have no question for defense counsel.
Main Judge: Witness is excused. Do you want to call any other witnesses?
Romo: Your honors, I don't wish to belabor this any longer. The defense rests.
Main Judge: Very well. This court will adjourn to consider a verdict.
Baltar: What a glorious moment in jurisprudence.
Roslin (to Cassidy): You did a great job.

(Galactica - Courtroom)

Marine: All rise.

(Judges enter the room)

Main Judge: Before I read the verdict, I'd like to make one thing clear. Like everything human, justice is imperfect. It's flawed. But it's those very imperfections that separate us from the machines. And maybe even makes us a species worth saving. The defendant will rise. Gaius Baltar, after carefully weighing the evidence, this tribunal, on a vote of three to two, finds you not guilty.
(crowd reacts - some cheer, others yell in disgust.)
Cassidy (to Romo): Good work.
Baltar (to media): I just knew that I was going to be acquitted, for the fact that I've been found innocent it shouldn't disguise in any way that this trial has been a total
(all hell is breaking loose)
Lee: Admiral, you've gotta get him outta here! Get him outta here, get him outta here!

(Galactica - Baltar's Cell)

Baltar: I knew right from the very start that if there was a way to demonstrate the sheer, what's the word I'm looking for, hypocrisy, hypocrisy is the word I'm looking for. Hypocrisy of the prosecutions case, then really the judges had no other option to find me not guilty.
Romo: Well your boundless confidence provided us with great solace throughout the proceedings.
Baltar: Look I want to thank you both, truly from the bottom of my heart. I am very very grateful for all you've done. On a personal note, if I could have seen the Admiral squirm just a little bit more, it wouldn't have hurt.
Lee: Now you listen to me. Don't push it, Doctor.
Baltar: Fine. Romo, um, perhaps we could have a chat. I thought about maybe doing a book tour around the fleet. And there's the publishing rights, there are issues about my security, where I'm going to live, what I'm going to do. Since we've forged this great relationship during the trial I thought you know, who better to uh.
Romo: Actually now that the fleet's legal system is in place, my not so inconsiderable talents are required elsewhere. So I'm afraid this is the end of our journey.
Baltar: Wait a minute, what about me? Wait a minute, wait please. Think about this for a second. Where am I going to live, what am I going to do, how am I going to survive?
Romo: Much as I hate to use a cat metaphor, Doctor, I think you'll land on your feet. Close the door on your way out.

(Galactica - Hallways)

Lee: Romo, one thing. When you put me on the stand, did you know what was going to happen?
Romo: I knew you were an honest man, Mr. Adama. Much unlike your Grandfather.
(Romo puts down his cane, and puts his glasses on and leaves. He never needed the cane.)

(Galactica - CIC)

Roslin: Gaius Baltar is innocent. This is something that makes my skin crawl.
Adama: Not guilty is not the same as innocent.
Roslin: This must have been particularly difficult for you. What you couldn't get the other two guys to budge? You voted for his acquittal didn't you?
Adama: I hate to say it, defense made their case, prosecution didn't.
Roslin: Gaius Baltar is a traitor, we both know that. Regardless of the outcome of this trial.
Adama: No ones asking anyone to forget, or to forgive. But we have to look to the future. Mr. Gaeta.
Gaeta: Sir.
Adama: Commence jump prep, we're going to the Ionian Nebula.

(Galactica - Hallways)

(Baltar walks through the hallway, looking at the ground, while people stare and call him things such as 'fraking jerk.")

(Galactica - CIC)

Gaeta: Jump coordinates have been distributed, Sir. All fleet ships show green for jump formation delta.
Adama: Initiate jump.
Gaeta: Aye, Sir. Jumping in three, two, one, jump. Jump complete, all ships reporting in Sir.
Adama: Very well Mr. Gaeta, commence DRADIS scan, let's see what's out there.
(Roslin begins to suddenly feel very sick. The power goes out.)
Adama: Sit Rep!
Gaeta: Uh, sensors show major power fluctuations, checking on fleet.

(Galactica - Hallways)

(Colonel Tigh has his ear to the ship, he hears something)

(Galactica - Hanger Deck)

Racetrack: Nuggets on me, Nuggets on me!

(Galactica - CIC)

Gaeta: Check auxiliary power.
Dee: We have negative auxiliary power, we're on batteries only.
Adama: Get ready for an engine restart.

(Galactica - Hallways)

(Baltar is approached by several women.)

Woman: Gaius, it's okay, come with me.
Baltar: Where are you taking me too?
Woman: To your new life, come on.

(He is robbed and then leaves with them)

(CapSix's dream - Opera house)

(CapSix and Baltar carry Hera into the main part of the opera house. They look up and see the final five, cloaked and illuminated.)

(Galactica - Hanger Deck)

Galen: Come on people let's get the power back up.
(He begins to hear the song again, louder this time, calling him out to him)
Galen: There must be some other way outta here.

(Galactica - Hallways)

Tigh: Said the joker to the thief.

(Galactica - Officer's rack)

Anders: There's too much confusion here.

(Galactica - Head)

Tory: I can't get no relief.

(Galactica)

(Galen, Anders, Tory, and Tigh are wandering around different areas of the ship. They eventually meet in the gym. Anders first, then Galen, then Tory. The music is loud)

(Galactica - Gym)

Tory: This isn't happening. Please tell me this isn't happening.
Galen: So that's it. After all this time. The switch goes off, just like that.
(Door opens - Colonel Tigh)
Tigh: Whoa.
Anders: Oh no way, I don't believe this. I'm not buying this, this is uh a trick. Come on, we're not. We're not.
Tory: What is that song, that. (Hums song. Anders, Tigh, and Galen join in)
Tigh: Alright that's enough Godsdammit! Deadbolt that fraking door! Forty years in the service, forty years. Two wars. Combat. Locked in that dungeon on New Caprica. Ellen. My Gods, what about Ellen?
Anders: No, no, no, no. Not after all this. Not after the resistance, and the occupation, after watching my friends die one after another for fraking this!?
Tory: Sam.
Anders: You stay the hell away from me. You all just stay the frak away from me.
Galen: Sam, it's true. We're Cylons. And we have been from the start.

(Galactica - CIC)

Roslin: What in the world is going on?
Adama: Some kinda power surge, get me a damage report, immediately.
Dee: The power outage was fleet wide Admiral. It was also simultaneously restored to all ships.
Roslin: Admiral! Admiral!
Gaeta: DRADIS contact! Massive Cylon fleet on intercept course!
Adama: Mr. Gaeta sound action stations immediately! XO, I want to emergency jump the entire fleet.
Helo: Sir, all fleet ships were powered down during the outage, it'll take at least twenty minutes to spool up the FTL drives.
Adama: We just don't have twenty minutes.
Gaeta (loudspeakers): Action stations, action stations, set condition one throughout the ship this is not a drill. All Viper pilots report to Vipers immediately. Inbound Cylon fleet. I repeat action stations, action stations set condition one throughout the ship, this is not a drill.

(Galactica - Gym)

(They have all heard the announcement.)

Tory: Gods, what are we gonna do?
Tigh: The ship is under attack, we do our jobs. Report to your stations!
Galen: Report to stations?
Tigh: My name is Saul Tigh, I am an officer in the Colonial Fleet. Whatever I am, whatever else it means, that's the man I want to be. And if I die today, that's the man I'll be.

(They leave. The song begins to play.)

(Galactica - Hanger Deck)

Cally: Where the hell have you been?
Galen: I'll tell you later, get that bird in the tubes get those steps off!

(Galactica - Hallways)

(Lee sees the people rushing by him, he decides to get his suit and get to his Viper)

(Galactica - CIC)

Adama: Arm and load all nuclear weapons.
Helo: Yes, Sir.
Adama: It's good to see you, Colonel.
Tigh: Good to be here, Admiral. You can count on me.
Adama: I never doubted it.
Tory: I'm here if you need me, Madam President.

(Space, Vipers launch song plays. Lee launches.)

Song: "'There must be someway outta here,' said the joker to the thief. "There's too much confusion, I get no relief."

(Galactica - CIC)

Gaeta: Alert Vipers are away.
Helo: Who's in Viper three?

(Space)

Song: "Businessmen, they drink my wine, plowmen dig my earth. None of them along the line know what any of it is worth."

Lee: Galactica, Apollo. I'm in Viper three, I have a bogey at my ten, I'm gonna go check it out.

Song: "No reason to get excited," the thief he kindly spoke. "There are many here among us who feel that life is but a joke."

Lee: Where'd he go, where the frak did you go?

Song: "But you and I, we've been through that, and this is not our fate. So let us not talk falsely now, the hour's getting late."

(Something flies over Lee's ship)
Lee: Whoa, what the frak!

(There is a Viper alongside Lee.)

Kara: Hi Lee.
Lee: Kara!?
Kara: Haha, don't freak out, it really is me. Haha! It's gonna be okay. I've been to Earth. I know where it is. And I'm gonna take us there.

Song: "All along the watchtower. All along the watchtower! Oh, yeah!"

(Shot pulls out from the Vipers, past the fleet, past the Cylon raiders, past the Cylon Basestars, past the nebula, through a solar system, and out above the Milky Way. Then the shot flies back into the Milky Way, through a solar system and focuses on a planet - Earth.)
